Cabin Rental Policy and Agreement
Escape to Blue Ridge, LLC serves as the agent and representative of all owners of cabins in our vacation home program, and is acting at all times, in and for the best interests of the owners. Escape to Blue Ridge, LLC agrees to rent owner's property according to contract and lease said property(s) to guest(s) per this contract. In return the guest agrees to pay all fees timely and in the manner accepted in this contract, abide by all house rules and governmental laws, and guests agrees not to re-let property or assign other rental rights with out prior written approval of Escape to Blue Ridge, LLC. The guest acknowledges that failure to abide by any portion of this contract constitutes a breach of this contract.
1.) RESERVATION & PAYMENT REQUIREMENTS.
- $250 deposit is required at time of reservation,
- A major credit card (MasterCard or Visa)
- Reservation costs is due 30 days prior to arrival unless options are prearranged. If guest desires to pay the balance by a means other than a credit card, please notify the
office at time of booking. Escape to Blue Ridge, LLC accepts bank checks drawn on US Banks, Money Order, Personal/Business checks. If alternative payment has not been received, guest agrees to allow Escape to Blue Ridge, LLC to charge the credit card on file for balance of reservation costs.
- Reservations made within 30 days of arrival require the balance to be paid in full at time of the reservation request.
- Major Credit Cards and Debit Cards (MasterCard, Discover or Visa),
- Bank/Cashier's Checks drawn on major US Banks,
- Personal/Business Checks drawn on major US Banks.
2). MINIMUM AGE REQUIREMENT: At least one guest must be 25 years or older. (Proof of age will be required at check-in)
3.) PROPERTY DAMAGE: Guest acknowledges and understands that he/she is financially responsible for any and all property damage that may occur during the stated rental period which can reasonably be attributed to the rental party's negligence or abuse.
4.) GUEST COUNT: Guest agrees that the premises shall be occupied by no more than the number of people paid for and stated herein. Occupancy is limited to registered guests only. Absolutely no overnight guests are allowed. Occupancy by more than the stated number of guests will result in the termination of the rental and the forfeiture of all rental fees, and deposits. Please notify the rental office at least 24 hours prior to arrival if your guests count changes.
5.) SECURITY DEPOSIT: A $250.00 security deposit will be charged on a credit card at the time of booking your reservation. Guest grants Agent express permission to charge the credit card provided for all charges due including additional rental fees, ancillary charges, or to cover any damage and/or additional cleaning charges generated during the rental period, as set out above in this agreement.
6.) LOSS OF SECURITY DEPOSIT: Guest agrees to follow all check-in and checkout procedures, and understands that the property must be left clean and undamaged. Guest understands that failure to follow the posted check-in and checkout procedures may result in the loss of all, or part, of the $250.00 security deposit and that Agent reserves the right to further bill him/her for additional cleaning or repairs. (Guest agrees to read all of the documents provided at check-in, as well as those printed in the information book and/or posted policies provided in the cabin.)
7.) DISPUTES: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in the County of Fulton, State of Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Fulton County Superior Court, Georgia. Guest(s) specifically consent to such jurisdiction and to extraterritorial service of process.
8.) CHECKS: All checks for payment must be received no later than 30 days prior to the stated arrival date. A $35.00 service charge will be incurred for all returned checks.
9.) CHECK-IN/CHECK-OUT TIME: Guest acknowledges and understands that check-in time is no earlier than 3:00 PM and checkout time is no later than 10:00 AM on the dates stated in the rental period above. Guest agrees that an unapproved late checkout will be assessed an amount equal to one-half the nightly rental fee for each 30 minute period past 10:00 AM.
- All trash and outside litter should be bagged and placed in the outside garbage cans.
- Wash, dry and put away all the dishes, pots, pans, and kitchen utensils.
- Remove bedding and place in the laundry room for the cleaning staff to wash.
- Set A/C to 78 or heat to 55 degrees depending upon the season.
- Lock all windows and doors.
10.) ALCOHOLIC BEVERAGE: The renter(s) agrees to abide by state law prohibiting the consumption of alcohol on the cabin property by minors. Furthermore, guest(s) agrees to not allow glass containers outside of the cabin.
11.) CABIN DESCRIPTIONS AND RATES: Information regarding the individual cabins is believed to be accurate but cannot be guaranteed. We have made every effort to ensure that all the information on Escape to Blue Ridge, LLC website is current and accurate. The possibility of errors and omissions does exist. We will be happy to confirm all the information or answer any of your questions prior to confirming your reservation. Rates, furnishings, fees and taxes are subject to change without notice. Rates for daily and weekly stays are found on our website at www.escapetoblueridge.com. These rates are based on a 4 person occupancy and each additional guest above the age of two is subject to additional charges as stated on our Rates and Policy page of the website. Minimum night requirements may vary during holiday, special events, etc and are included on our website. Escape to Blue Ridge, LLC reserves the right to discount prices for any reason to include but not limited to large groups, extended stays, season, or association/affiliations.
12.) CABIN FURNISHINGS, DECOR & EQUIPMENT: All cabins are privately owned with furnishings and equipment provided by the cabin owner. Escape to Blue Ridge, LLC cannot make changes to furniture or decor. Moving of furniture or re-arranging of pre-wired home electronic equipment is prohibited. If you require special appliances or equipment, please bring them with you. Decor, style, color and themes will vary between cabins. Furnishings are subject to change without notice.
13.) HOT TUB CLEANING: Hot tubs are cleaned prior to your arrival. There is a $35 charge if you wish to have an additional cleaning of the Hot Tub during your stay. Instructions are provided at the cabin for proper operation and easy maintenance during your stay. PETS are NOT allowed in the hot tub. If a pet or pet hair is found in the hot tub, a charge of $150.00 plus the cost of a replacement filter ($35.00 - $90.00) will be charged to the guest's credit card. It is guests responsibility to replace the top after every use so that stray animals do not get in the hot tub.
14.) KEYS: Our cabins are privately owned and Guests are responsible for lost keys. The property must be re-keyed in the event the keys are lost, misplaced or not returned. Guests will be responsible for the cost of this procedure.
15.) LINENS: All cabins are supplied with linens (enough for your guests), towels, blankets and pillows. These items are not changed during your stay. Escape to Blue Ridge, LLC provides an initial supply of paper products, soaps, detergents and trash bags etc. for your convenience.
16.) REFUNDS: Rate Adjustments are not made for inconvenience due to construction noise, road repairs, early departures, delayed arrivals or reducing the number of nights reserved with less than 30 days notice, unless otherwise stated in this contract or subsequently agreed to in writing by legal addendum. No refunds or reschedules are permitted due to inclement weather.
17.) REPAIRS / SERVICE CALLS: Escape to Blue Ridge, LLC cannot guarantee against mechanical failure of heating, air-conditioning, Hot Tubs, TV's, Satellite Receivers, VCR/DVD players or other appliances. Promptly report any equipment that is not operating properly. Escape to Blue Ridge, LLC will make every effort to resolve the problem as reasonably soon as possible. Should a repairperson make a call to a cabin and find the equipment in working order and the problem was due to Guest(s) oversight or neglect, the charge for the service will be charged to the Guest(s). All normal maintenance repairs must be reported to Escape to Blue Ridge, LLC between 9 AM and 5 PM. Emergency Repair items (heating, water, etc.) may be reported 24 hours a day. Guest(s) understand and agrees to allow Escape to Blue Ridge, LLC or repair personnel immediate access to the cabin for the purpose of making repairs.
18.) SPAS/HOT TUBS: The Spa cover must be in place and latched when the hot tub is not in use. Children under the age of 18 are not allowed to use the hot tub without constant adult supervision. Temperature of the hot tub should NEVER be elevated above 104 degrees. Pregnant woman and young children should not use the hot tub without first consulting a physician. Persons with injuries or medical conditions should consult a physician prior to using the hot tub. Extreme care should be taken to ensure that hair and clothing does not become entangled in the drain(s). Pets are never allowed in the hot tub. In addition to adhering the hot tub cover after each use, please also add a capful of shock enhancer in the hot tub after every use to insure proper sanitation.
19.) TAXES AND FEES: Published nightly rates are not inclusive of applicable sales tax, and additional fees may be applied at the time of reservation.
20.) TELEPHONE CALLS: All cabins are equipped with a telephone. All long distant calls are to be placed by credit card, 800 numbers, or calling card. Some cabins are equipped with free long distance.
21.) TERMINATIONS BY OWNER/SUBSTITUTIONS: Escape to Blue Ridge, LLC strives to comply with your reservation requests, however, due to circumstances beyond our control such as, but not limited to, changes in ownership, properties being removed from the vacation program, mechanical problems, etc. Escape to Blue Ridge, LLC cannot guarantee a specific cabin. Escape to Blue Ridge, LLC reserves the right to change your cabin without notice or liability should the cabin become unavailable. The guest agrees to hold harmless the owner or Escape to Blue Ridge, LLC for events beyond their control which may interfere with the guest's visit. This may include but not limited to Acts of God, acts of Governmental agencies, fire, war, inclement weather and construction noise. The guest agrees Escape to Blue Ridge, LLC and/or owner is not obligated to rebate or refund any fee in these circumstances. Escape to Blue Ridge, LLC will offer a comparable cabin at the same rate if available or you are provided the option of canceling the reservation and receiving a complete refund. Escape to Blue Ridge, LLC will give as reasonable amount of notice as possible so other arrangements can be made.
22.) DAMAGE TO HOME/DECOR/FURNISHINGS: Rental guests are solely responsible for damage(s) to the home, decor, equipment, and/or furnishings or removal of said items during the reservation period caused by any member of their party regardless of whether the member(s) is duly authorized (i.e. unauthorized guest or pet) by the reservation invoice.
23.) HOUSE PARTIES ARE NOT ALLOWED: Rental guests understand that Escape to Blue Ridge, LLC will accept responsible adults over the age of 25 only. Guest(s) agree that no more than the number of persons listed on the reservation agreement shall occupy the premises without prior written approval by Escape to Blue Ridge, LLC. If the unit is occupied by more than the number of persons stated on the reservation, the result will be a loss of total rent and security deposit, additional charge to your credit card for the non-registered guests, and eviction. Guests shall not disturb or offend any neighbors, discharge firearms, create loud or obnoxious noises, or use fireworks of any kind in accordance with State of Georgia and Fannin County laws.
Escape to Blue Ridge, Inc. reserves the right to refuse service to anyone. All rental cabins are leased without regard to race, color, religion, sex, sexual orientation, national origin or handicap.
24.) NO FIREARMS - NO FIREWORKS - NO ATVs: The occupancy and use of the premises shall not be such as to place the property in danger of damage or to disturb and/or offend area neighbors or residents. The Agent reserves the right to terminate this agreement and request loud or unruly guests to vacate the premises immediately. Said discharge shall not result the refund of any rental fees.
25.) EARLY DEPARTURE/LATE ARRIVAL POLICY: No refunds will be made for early departures or delayed arrivals. No refunds or schedule changes will be made due to inclement weather.
26.) NO PETS: Authorized PETS Only: Only certain cabins allow pets. All guests must recieve prior approval for pets in our pet friendly cabins and all related costs must be paid. If an unapproved pet belonging to any member of the rental party, or guest of the rental party, is found to be in or on the premises of any cabin, Guest will be removed from the property and agrees that the full rental fee and $250.00 deposit will be forfeited and acknowledges that any damage done by said pet shall be his/her financial responsibility.
27.) NO SMOKING: This is a non-smoking cabin. If it is found that any member of the rental party, or guest of the rental party, has smoked inside the cabin, your $250.00 security deposit will be forfeited. The entire cabin is designated as a No Smoking Area. Guests may, however, smoke in the outside deck/patio areas. Cigarette butts must not be disposed of in the yard or anywhere on the property. If cigarette butts are found on the grounds by caretakers there is a $100 cleaning fee for pick up.
28.) NO PAY-PER-VIEW: Guest acknowledges and understands that there is a pay-per-view block on the satellite dish/cable box and that any pay-per-view, or billable programs of any kind, charged during the stated rental period will be billed back to the Guest upon receipt of the charges. All cabins are privately owned and have different subscription packages for satellite. Escape to Blue Ridge, LLC does not guarantee any programs or events.
29.) WILDLIFE: All of the cabins are located in the mountains of North Georgia. As such, you are likely to encounter wildlife (deer, bears, raccoons, snakes and bugs of various types, including wasps and/or hornets, etc...). Neither Escape to Blue Ridge, nor the property owner, will accept responsibility for any injury caused by said wildlife.
30.) HOLD HARMLESS: Guest acknowledges and understands that each and every guest, or guardian, is solely responsible for any accident or injury to any person while in-residence, and neither the Owner nor the Agent accepts any legal or financial responsibility. Guests, and guardians, assume all risk of injury or other loss resulting from any recreational activity and will hold the Agent and Owner harmless with respect thereto. Guest(s) hereby agrees to indemnify and hold Escape to Blue Ridge, LLC and/or the property owner harmless from any and all claims, including those of third parties, arising out of or in any way a result of the Guests use of the premises or items therein.
31.) LOSS OF PERSONAL ITEMS: Guest acknowledges and understands that each guest, or guardian, is solely responsible for any loss by any person while in residence including the loss of money, jewelry or any other personal item.
32.) LOCKED STORAGE AREAS: There is a locked cabinet or closet in this cabin. This is a storage area for cleaning supplies and nothing of value is kept here. PLEASE NOTE: Your deposit will be forfeited if either the lock or the door is broken or tampered with.
33.) FIREPLACE(S): Fireplace(s)inside this property may be equipped with propane gas logs which must not be disturbed. Guest agrees that under no circumstances will any member of the party de-install the logs, rearrange the logs or burn anything other than the propane provided in the interior fireplace(s). To do so may cause damage to the logs and may also allow poisonous carbon monoxide to leak into the cabin which could prove harmful to your party or future guests. THIS IS A SAFETY ISSUE Any evidence of tampering will result in the loss of your deposit!
If the cabin is equipped with a wood burning fireplace, firewood is provided October 1st - March 31st. Wood burning fireplaces do not have a gas starter. If you are not proficient at starting a fire without one, you might want to bring small "Duraflame" type logs or "fire starters". Limit to three (3) pieces of firewood in wood burning fireplaces at a time to prevent fire hazards. ABSOLUTELY NO LIQUID ACCELERANT IS ALLOWED! THIS IS A SAFETY ISSUE - Any evidence of accelerant use will result in the loss of your deposit.

34.) Escape to Blue Ridge, LLC cannot be held responsible for the failing of any other company due to said company's error or service interruption. (i.e. electricity, water, gas, etc..) However, we guarantee that we will do all that is humanly possible to remedy any issue in the shortest time possible.
35.) Escape to Blue Ridge, LLC reserves the right to substitute a comparable cabin in the unlikely event that the reserved cabin is unavailable for any reason. This will be done only as a last resort when a maintenance issue or service interruption. (i.e. electricity, water, gas, etc..) renders the cabin uninhabitable, the property is sold or the property management agreement is terminated.
36.) GRILLS: All grills use propane gas for cooking. DO NOT PUT CHARCOAL IN A GAS GRILL!
37.) CANCELLATION POLICY: Cancellations made 30 days prior to arrival will result in a full refund of the rental deposit less a $25 cancellation fee and the $35 non-refundable reservation fee. Cancellations made with less than 30 days notice, but at least 14 days prior to arrival date will result in the forfeiture of one-half of the rental deposit ($125) Cancellations made with less than 14 days notice, but at least 7 days prior to arrival date will result in the full forfeiture of the rental deposit ($250). Cancellations made less than 7 days prior to the planned arrival date will result in a charge to the credit card provided in the balance of the rental charge.
